Terms of Use

Our services are offered through the website, mobile applications and related products operated by Rooftr Technologies Private Limited.

For purposes of these Terms:
1.1 “Platform”
Means the Rooftr website, web application, mobile application, software, databases, dashboards, APIs, communication systems and related technology operated or made available by Rooftr.
1.2 “Services”
Means all products, tools and services provided through the Platform, including property discovery, marketplace services, CRM, lead management, property management, proposal generation, lease workflows, analytics, directories, communication tools, premium services and other services introduced by Rooftr from time to time.
1.3 “User”
Means any individual or legal entity accessing or using the Platform, including brokers, property owners, landlords, occupiers, tenants, developers, enterprises, consultants, service providers and other registered users.
1.4 “Credits”
Means non-monetary, platform-specific service credits issued or sold by Rooftr that may be used by eligible Users to access or avail specified premium Services on the Platform.
1.5 “Welcome Credits”
Means promotional Credits that Rooftr may provide to an eligible newly registered User, currently consisting of 100 Credits, subject to applicable eligibility and promotional conditions.
1.6 “Credit Plan” or “Credit Pack”
Means a package of Credits offered by Rooftr for purchase by Users.
1.7 “Premium Services”
Means Services for which Rooftr requires payment in Credits or another expressly disclosed payment method.
1.8 “Content”
Means property information, photographs, documents, descriptions, text, videos, logos, communications, data and other information uploaded, submitted, transmitted or displayed through the Platform.

By accessing or using Rooftr, you agree to:
~ comply with these Terms;
~ comply with all applicable laws and regulations;
~ provide accurate information;
~ use the Platform only for lawful purposes;
~ comply with applicable property, real estate, tax, consumer protection, data protection and other laws applicable to your activities.
These Terms apply to both free and paid Users.

Rooftr may provide:
~ Property Marketplace;
~ Property discovery and search;
~ Direct Owner property opportunities;
~ CRM;
~ Lead and inquiry management;
~ Property and inventory management;
~ Private inventory details storage;
~ Proposal creation;
~ Property listings comparison;
~ Lease and lease administration tools;
~ Directory services;
~ Communication and notification tools;
~ Calendar and task management;
~ Analytics and reporting;
~ Developer and project pages;
~ Property verification indicators;
~ Premium Services;
~ other technology-enabled real estate services.
Rooftr is a technology platform and, unless expressly agreed otherwise in writing, does not act as a real estate broker, agent, developer, owner, landlord, tenant, legal advisor, investment advisor, fiduciary or representative of any User.

Where any portion of the Platform is identified as Beta, Early Access, Preview or similar:
~ features may be modified;
~ functionality may be added or removed;
~ technical errors may occur;
~ data may occasionally be delayed or unavailable;
~ third-party integrations may fail;
~ service availability may vary.
The Platform and Services are provided on an “as is” and “as available” basis to the maximum extent permitted by applicable law.
Rooftr does not guarantee uninterrupted, error-free or permanently available access.

Users must:
~ be at least 18 years old;
~ have legal capacity to enter into a binding agreement;
~ provide accurate registration information;
~ comply with applicable laws;
~ use the Platform for legitimate commercial or personal purposes permitted by these Terms.
Where a User registers on behalf of an organisation, the User represents that they are authorised to bind that organisation.

Users shall:
~ provide accurate information;
~ maintain current account information;
~ protect passwords and authentication credentials;
~ not share account credentials without authorisation;
~ immediately notify Rooftr of suspected unauthorised access;
~ remain responsible for activity conducted through their account, subject to applicable law.
Rooftr may require email, mobile, identity, business or other verification before providing certain Services.
Rooftr may restrict access to particular Services based on verification status, account status, geography, usage, eligibility or other legitimate operational requirements.

7.1 General
Rooftr operates a Credit-based system through which eligible Users may purchase or receive Credits and use those Credits to access specified Premium Services.
Credits are intended solely for use within the Rooftr Platform.
7.2 Credits are not money
Rooftr Credits:
~ are not legal tender;
~ are not bank deposits;
~ are not cash;
~ are not securities;
~ are not investments;
~ are not cryptocurrency;
~ are not electronic money;
~ do not represent a deposit with Rooftr;
~ do not earn interest or returns;
~ have no independent monetary value outside the Platform.
7.3 No cash withdrawal
Credits cannot be:
~ withdrawn for cash;
~ transferred to a bank account;
~ converted into cash;
~ exchanged for monetary value;
~ redeemed through an ATM or payment network.
7.4 No User-to-User transfer
Unless Rooftr expressly introduces a transfer facility in writing, Credits cannot be:
transferred between Users;
~ sold;
~ gifted;
~ assigned;
~ pledged;
~ exchanged between accounts.
7.5 No third-party payments
Credits cannot be used to make payments to property owners, brokers, developers, tenants, landlords or other third parties.
Credits are usable only for eligible Services supplied or made available by Rooftr.
7.6 Premium Service Pricing
Rooftr may assign a Credit requirement to individual Premium Services.
The applicable Credit requirement shall be displayed to the User before the relevant Service is confirmed, wherever reasonably practicable.
Rooftr may change the Credit requirement for a future transaction, subject to applicable law and reasonable disclosure.

Welcome Credits:
~ are promotional Credits;
~ have no cash value;
~ cannot be withdrawn or transferred;
~ may be subject to eligibility restrictions;
~ may be subject to expiry conditions displayed at the time of issuance;
~ may be cancelled or reversed where obtained through fraud, abuse, duplicate accounts or technical error.
Rooftr may modify or discontinue promotional Credit programmes subject to applicable law.

(A) CREDIT EXPIRY
Credits may have a validity period as specified at the time of issuance or purchase.
The applicable expiry date shall be displayed to the User where technically available.
Upon expiry, unused Credits may cease to be available for use, subject to:
the applicable Credit terms;
promotional conditions;
refund/cancellation rules;
applicable law.
Where multiple Credit balances exist, Rooftr may establish a reasonable consumption order based on the respective expiry dates.
Rooftr shall disclose the applicable mechanism within the Platform where reasonably practicable.
(B) CREDIT TRANSACTIONS AND BALANCE
Rooftr may maintain a digital Credit ledger associated with each User account.
The ledger may record:
Credits issued;
Welcome Credits;
Credits purchased;
Credits used;
Credits expired;
Credit adjustments;
reversals;
applicable Service;
transaction reference;
date and time;
balance following the transaction.
Users should review their Credit balance and transaction history regularly and promptly report suspected errors.
(C) CREDIT ERRORS, REVERSALS AND FRAUD
Rooftr may correct or reverse Credits where:
Credits were issued due to technical error;
a payment was reversed or failed;
a transaction was fraudulent;
a transaction was unauthorised;
Credits were obtained through abuse;
duplicate Credits were incorrectly issued;
a Service transaction failed due to a technical issue.
Where a Credit deduction occurs due to a confirmed technical failure attributable to Rooftr, Rooftr may restore the relevant Credits or provide another appropriate remedy, subject to applicable circumstances and law.

*Applicable taxes, including GST where applicable, are additional unless expressly stated otherwise at checkout.
The applicable price, tax, Credit quantity, validity and other purchase conditions displayed at checkout shall govern the particular transaction.
Important
The Credit Plans do not represent different levels of ownership, investment or financial participation in Rooftr.
Purchasing a Credit Plan does not provide any equity, ownership, profit-sharing, investment return or other financial interest in Rooftr.

Rooftr does not store complete card, banking or payment credentials where such information is processed directly by an authorised payment service provider.

A successful payment does not necessarily mean that a Premium Service has been successfully completed. The Service is subject to the relevant Service conditions.
Rooftr may maintain payment and transaction records for accounting, taxation, compliance, fraud prevention and customer support purposes.

A refund or adjustment may be considered where:
~ payment was duplicated;
~ payment was successfully charged but Credits were not delivered due to a Rooftr technical failure;
~ Credits were incorrectly deducted due to a confirmed Rooftr system error;
~ Rooftr expressly agrees to a refund;
~ applicable law requires a refund.
Credits already consumed for successfully delivered Services are generally not refundable.
Where a payment is reversed, cancelled or refunded, Rooftr may reverse the corresponding Credits associated with that transaction to the extent permitted by law.

Property listings may be submitted by:
~ owners;
~ landlords;
~ brokers;
~ developers;
~ occupiers;
~ authorised representatives;
~ other permitted Users.
Users are solely responsible for ensuring that they have the right and authority to upload and publish the relevant information.
Rooftr does not guarantee:
legal ownership;
~ title;
~ possession;
~ authority to lease or sell;
~ availability;
~ pricing;
~ area;
~ approvals;
~ RERA status;
~ encumbrance status;
~ zoning;
~ building permissions;
~ accuracy of any listing.

A “Verified” or similar indicator:
does not constitute legal title verification;
does not constitute a legal opinion;
does not constitute RERA certification;
does not guarantee transaction completion;
does not constitute a warranty by Rooftr.
Users must independently verify all material property information before entering into any transaction.

Rooftr does not guarantee that:
a property will be leased;
a property will be sold;
a requirement will be fulfilled;
a lead will convert;
a User will receive a response;
a transaction will close;
information provided by another User is accurate.
All negotiations, commercial terms, documentation, payments, inspections and transactions between Users are undertaken at their own risk.
Users remain responsible for obtaining appropriate professional advice, due diligence and documentation.

Users involved in real estate activities shall comply with laws applicable to them, including where applicable:
RERA;
applicable state real estate laws;
municipal requirements;
building and zoning requirements;
tax laws;
consumer protection laws;
data protection laws;
advertising laws;
other applicable regulatory requirements.
Rooftr does not assume a User's statutory or regulatory obligations.

Users retain ownership of Content they lawfully own.
By uploading Content, the User grants Rooftr a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, display, transmit and otherwise use such Content to the extent reasonably necessary to:
provide Services;
display listings;
operate the Platform;
create proposals;
provide analytics;
maintain security;
moderate Content;
improve Platform functionality;
communicate with Users.
Users represent that they have all necessary rights and permissions to upload such Content.

Rooftr may use automated systems, artificial intelligence, machine learning and manual review for:
property categorisation;
content moderation;
fraud detection;
listing quality;
recommendations;
analytics;
search;
workflow automation;
communication;
other Platform functions.
AI-generated or automated information may contain errors.
Users should independently verify important information before relying upon it for legal, financial or transaction decisions.

Users shall not:
provide false information;
impersonate another person;
create fraudulent accounts;
upload unlawful property information;
list property without authority;
misrepresent property ownership;
engage in fraud;
manipulate listings;
abuse Credits;
attempt to obtain Credits through technical vulnerabilities;
resell Rooftr Services without authorisation;
share credentials unlawfully;
scrape or harvest Platform data;
use bots or unauthorised crawlers;
reverse engineer the Platform;
introduce malware;
interfere with Platform security;
circumvent access controls;
spam other Users;
harass other Users;
use Rooftr for unlawful activity;
violate intellectual property rights;
violate applicable real estate laws.

A lead may:
be incomplete;
become unavailable;
be duplicated;
have incorrect information;
be withdrawn by its source;
not result in a transaction.
Where Credits are charged for an eligible lead or contact service, the applicable Credit requirement shall be disclosed before confirmation.

All rights in the Rooftr Platform, including:
software;
source code;
UI/UX;
design;
databases;
trademarks;
logos;
graphics;
content created by Rooftr;
documentation;
workflows;
proprietary systems;
technology;
are owned by or licensed to Rooftr.
No User receives ownership rights merely by accessing or using the Platform.

Rooftr may send Users:
transactional emails;
account notifications;
security notifications;
payment confirmations;
Credit notifications;
Service notifications;
support communications;
legally required notices;
promotional communications where permitted.
Users may manage applicable marketing communications through available unsubscribe or communication-preference mechanisms.
Certain essential communications may continue where necessary for account, security, payment or Service administration.

Rooftr may integrate with third-party services including:
payment gateways;
email providers;
WhatsApp or messaging providers;
calendar providers;
analytics platforms;
cloud infrastructure;
mapping services;
authentication services;
other technology providers.
Use of third-party services may be subject to their own terms and privacy policies.
Rooftr is not responsible for failures, outages or policies of independent third-party providers except to the extent required by applicable law.

Rooftr may collect and process personal data necessary to provide the Platform and Services.
This may include:
name;
email;
mobile number;
company information;
account information;
property information;
transaction information;
Credit purchase and usage information;
device information;
IP address;
login information;
usage information;
communication records;
support information.
Rooftr shall process personal data in accordance with its Privacy Policy and applicable Indian data protection laws.
India's DPDP framework now includes notified 2025 Rules with a phased implementation framework. Rooftr should therefore maintain its Privacy Policy, consent/notice flows, rights mechanisms, retention practices and security controls consistently with the provisions applicable to Rooftr at the relevant time.

Rooftr will implement reasonable technical and organisational safeguards appropriate to the nature of the information processed.
However, no internet-based system can be guaranteed to be completely secure.
Users acknowledge that:
internet transmission carries inherent risks;
third-party infrastructure may be involved;
security incidents may occur despite reasonable safeguards.
Rooftr shall respond to security incidents in accordance with applicable law and its internal incident-response procedures.

Rooftr may use:
essential cookies;
authentication cookies;
analytics cookies;
preference cookies;
performance technologies;
similar tracking technologies.
Cookies may be used to:
maintain sessions;
authenticate Users;
remember preferences;
improve Platform functionality;
understand usage;
improve Services.
Users may control cookies through browser settings, although disabling certain cookies may affect functionality.

Rooftr may operate verification, moderation and reporting mechanisms designed to improve Platform integrity.
These may include:
User verification;
property verification;
AI-assisted moderation;
manual review;
abuse detection;
fraud detection;
reporting tools;
account restrictions.
Users may report suspected:
fraud;
impersonation;
fake property listings;
misleading information;
abusive conduct;
suspicious activity;
unauthorised use.
Reports may be investigated by Rooftr.

Rooftr may suspend, restrict or terminate an account where reasonably necessary due to:
breach of these Terms;
fraud;
unlawful activity;
misuse of Credits;
payment issues;
security concerns;
unauthorised access;
misleading information;
abuse of other Users;
regulatory requirements;
operational or security reasons.
Where appropriate and legally permissible, Rooftr may provide notice or an opportunity to remedy a breach.
Rooftr may immediately restrict access where continued access presents a security, fraud, legal or material operational risk.

Upon account termination:
access to the account may cease;
unused Credits may become unavailable;
promotional Credits may be cancelled;
Credits obtained fraudulently may be reversed;
outstanding payment obligations may survive termination.
No termination provision is intended to remove rights that cannot lawfully be excluded.

To the maximum extent permitted by applicable law, the User agrees to indemnify and hold harmless Rooftr, its directors, officers, employees, affiliates, contractors and service providers from claims, losses, liabilities, costs and expenses arising from:
violation of these Terms;
unlawful use of the Platform;
fraudulent activity;
User Content;
property listing disputes;
transactions with other Users;
infringement of third-party rights;
regulatory violations;
misuse of Credits;
unauthorised access caused by the User's acts or omissions.

To the maximum extent permitted by applicable law, Rooftr shall not be responsible for:
inaccurate User-generated listings;
transaction disputes between Users;
failure of a property transaction;
loss of business opportunity;
third-party platform failures;
internet or infrastructure failures;
unauthorised conduct of another User;
indirect or consequential losses;
loss of profits;
loss of goodwill;
loss of anticipated business.
Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

Rooftr shall not be responsible for delay or inability to provide Services caused by circumstances beyond its reasonable control, including:
natural disasters;
fire;
flood;
epidemic/pandemic;
war;
civil unrest;
governmental restrictions;
regulatory action;
cyber incidents;
internet failures;
cloud infrastructure failures;
telecommunications failures;
power failures;
third-party service outages.

Users may contact Rooftr regarding:
account issues;
Credits;
payments;
Services;
privacy matters;
security concerns;
complaints;
property listing concerns.

Rooftr may maintain internal complaint and support records for resolution, compliance and audit purposes.

Rooftr will provide applicable information relating to:
price;
taxes;
Services;
Credits;
applicable validity;
cancellation;
refund terms;
customer support;
through appropriate Platform interfaces.
India's Consumer Protection (E-Commerce) Rules, 2020 apply to goods and services bought or sold over digital/electronic networks, including digital products, and should be considered alongside the Platform's consumer-facing disclosures.

Rooftr may:
introduce new Services;
modify existing Services;
discontinue Services;
modify Credit requirements;
modify pricing;
modify Platform functionality.
Where changes materially affect an existing contractual obligation, Rooftr will provide notices or remedies where required by applicable law.

Users may receive confidential business information through the Platform.
Users shall not misuse or disclose confidential information obtained through Rooftr except:
with proper authorisation;
as required for the relevant transaction;
as required by law.

Users using Rooftr for business purposes represent that:
they are authorised to act for the relevant organisation;
their activities comply with applicable professional and regulatory requirements;
they have appropriate authority to upload and share company/property information.

Rooftr does not provide:
legal advice;
tax advice;
investment advice;
title opinions;
architectural certification;
structural certification;
RERA certification;
financial advice.
Users should obtain appropriate professional advice before making material legal, financial or real estate decisions.

These Terms, together with the applicable:
Privacy Policy;
Cookie Policy;
Trust & Safety Policy;
Credits Policy;
Refund & Cancellation Policy;
other policies expressly incorporated by reference;
constitute the agreement between the User and Rooftr concerning use of the Platform.
