Terms of Use & Legal Policies – Rooftr

Effective Date: August 1, 2025

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User") and Rooftr Technology Private Limited ("Rooftr", "we", "our", or "us"), the owner and operator of www.rooftr.com ("Website"). By accessing or using the Website and/or any services provided by Rooftr (collectively, the "Services"), you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using any part of the Website or Services, including CRM tools, property listings, proposal builders, or dashboards, you accept these Terms in full. If you do not agree, you may not access or use the Services.

2. Services Offered

Rooftr.com is a technology platform that provides:

  • SaaS-based CRM for real estate stakeholders (brokers, developers, owners, tenants, seekers)
  • Classified listings for commercial and residential properties
  • Lease and property management tools
  • Dashboards and analytics for leads, deals, and inventory
  • Calendar and notification modules for transaction workflows
  • Proposal creation and sharing system
  • Multi-license access for brokerage teams and enterprises
  • Directory of brokers, developers, and service professionals
  • Verified property inventory with ownership/contact details (subject to disclaimer)
  • Additional services may be introduced or discontinued at Rooftr’s discretion.

3. Eligibility and Access

Users must be 18 years or older and legally capable of entering a binding agreement. Access may vary by subscription type, user role, or location.

4. User Registration & Account Security

To access CRM features or listings, users must register with accurate, complete information. Users are responsible for securing login credentials and all activity under their account.

5. Subscription and Payments

  • Certain features require a paid subscription.
  • Payments must be made to Rooftr Technology Private Limited via authorized channels.
  • Subscriptions may auto-renew unless canceled before the renewal date.
  • No refunds will be issued unless stated otherwise in a promotional offer.
  • Accounts with payment defaults may be suspended.

6. Platform Usage Rules

Users agree not to:

  • Share CRM access with unauthorized users
  • Upload false or misleading property data
  • Scrape or export data without explicit permission
  • Abuse APIs or circumvent platform restrictions

Note: Rooftr reserves the right to audit usage and take action for violations.

7. Listing and Property Data

Users agree to:

  • Upload only accurate and lawful property information
  • Not list properties without legal authority or representation
  • Avoid using Rooftr data for competitive platforms

Note: Listings are moderated but not guaranteed to be accurate. Verification refers to internal vetting, not legal title verification.

8. Intellectual Property

All intellectual property on Rooftr.com (including code, UI/UX, content, and trademarks) is owned by Rooftr or its licensors. Users may not reproduce, reverse-engineer, or redistribute without written consent.

9. Prohibited Conduct

Users must not:

  • Violate any applicable Indian laws or real estate regulations
  • Harass, impersonate, defraud, or spam other users
  • Upload viruses, malware, or malicious code
  • Use bots, crawlers, or unauthorized scripts

10. Termination

Rooftr may suspend or terminate access for:

  • Violation of these Terms
  • Unethical, illegal, or fraudulent behavior
  • Failure to verify account or settle dues

11. Limitation of Liability

Rooftr is a neutral tech platform. We are not liable for:

  • Listing accuracy or completeness
  • Service interruptions or downtime
  • Disputes between users (e.g., developers, brokers, seekers)

12. Indemnity

Users agree to indemnify Rooftr and its affiliates against any liabilities, claims, or losses arising from:

  • Use or misuse of the Services
  • Violation of Terms
  • Disputes with third parties

13. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Disputes shall be resolved via arbitration in Gurugram, Haryana under the Arbitration and Conciliation Act, 1996. The courts in Gurugram shall have exclusive jurisdiction.

14. Modifications

Rooftr may modify these Terms at any time. Updates will be notified via email or platform popups. Continued use implies acceptance of revised Terms.

Privacy Policy

Effective Date: August 1, 2025

This Privacy Policy outlines how Rooftr Technology Private Limited ("Rooftr") collects, uses, and protects personal data from users of www.rooftr.com.

A. Data We Collect

  • Personal Info: Name, phone, email, company name, PAN/Aadhaar (if required)
  • Property Info: Listings, preferences, floor plans, ownership documents
  • Behavioral Data: Device/browser data, usage patterns, cookies

B. Usage of Data

  • To provide personalized CRM, listings, and dashboard features
  • To process payments, generate proposals/reports
  • To send transactional or promotional communication (SMS, WhatsApp, email)
  • To comply with regulations (KYC, RERA)

C. Data Retention

We retain data as long as necessary to deliver services and as per applicable laws. Users can request deletion at support@rooftr.com. We aim to process deletion requests within 15 business days, subject to legal exceptions.

D. Data Sharing

We do not sell personal data. Sharing may occur with:

  • Registered brokers/agents upon user interaction
  • Government agencies if required by law
  • Technology partners under strict data confidentiality protocols

E. Security

Rooftr uses encryption and secure hosting protocols. However, no system is 100% immune. Users are responsible for protecting their login credentials.

Cookie Policy

Rooftr uses cookies and trackers to:

  • Maintain session login
  • Optimize UX and personalize listings
  • Track performance via analytics tools (Google Analytics, Mixpanel)

You can disable cookies through browser settings. Some functionality may be affected.

Refund & Cancellation Policy

A. Subscription Purchases

All purchases for CRM access, lead credits, or premium features are non-refundable, unless explicitly mentioned in a promotional offer.

B. Cancellation of Subscriptions

  • Recurring subscriptions can be canceled via the CRM dashboard.
  • No partial refunds will be issued.
  • Cancellations take effect from the next billing cycle.

C. Account Suspension

No refunds will be granted if Rooftr suspends an account for policy violations or misconduct.

User Agreement for Paid Subscribers

A. Scope

Applies to paid tools including:

  • CRM Dashboard
  • Proposal Builder
  • Premium Listing Access
  • Calendar & Notification Modules
  • Analytics Dashboards

B. Use & License

Paid tools must be used for real estate business purposes only. Do not share login credentials or misuse licenses.

C. Auto-Renewals

Subscriptions auto-renew unless canceled. Renewal notices will be sent before billing.

D. Data Ownership

Users retain ownership of uploaded data. Rooftr may use anonymized, aggregated data for service improvement.

Vendor/Partner Terms (Brokers, Developers, Landlords)

A. Authenticity

Vendors must:

  • List only properties they lawfully represent
  • Upload valid ownership/floor plans and accurate pricing

B. Communication

Respond to verified Rooftr leads within 24–48 hours. Avoid unsolicited or spammy communication.

C. Legal Compliance

Comply with all RERA and property laws. Provide valid registration/licensing if applicable.

D. Suspension

Rooftr may suspend access for:

  • Fraudulent listings
  • User complaints
  • Violation of platform policies

Trust & Safety

Rooftr prioritizes platform integrity by:

  • Verifying brokers and property listings wherever feasible
  • Moderating content using AI-driven tools
  • Allowing users to report abuse or suspicious activity
  • Encrypting user communications and access logs

Third-Party Tools Disclaimer

Rooftr integrates with third-party platforms (email, calendar, payments, analytics, etc.). We are not liable for their availability, uptime, or terms of use.

Force Majeure Clause

Rooftr shall not be held liable for service disruption caused by:

  • Natural disasters
  • Cyberattacks or system outages
  • Regulatory shutdowns
  • Acts beyond our reasonable control

Governing Law & Dispute Resolution

All terms and policies are governed by Indian law. Disputes will be resolved via arbitration in Gurugram, Haryana. Courts in Gurugram will have exclusive jurisdiction.
